Terms of Service

1. Acceptance
By creating an account or using VoxSim, you agree to these Terms of Service. If you are accepting on behalf of an organisation, you represent that you have authority to bind that organisation. Use of the platform by minors under 18 is prohibited.
2. Subscription Plans and Pricing
All prices are in EUR (exclusive of VAT where applicable). Subscriptions are billed monthly in advance via Stripe. There are no refunds for partial months.

Karargah+ (€224,000 / 6 months) is available by separate contract. Prices may change with 30 days notice to active subscribers.
3. Permitted Uses
VoxSim is a decision-support platform. You may use it for:
- Scenario planning and policy research
- Pre-publication content testing
- Academic and journalistic analysis (Akademi/Medya plan)
- Crisis preparedness and communication strategy
4. Prohibited Uses
The following uses are strictly prohibited and will result in immediate account termination:
- Producing manipulative, deceptive, or disinformation content intended for publication
- Micro-targeting or building individual psychological profiles
- Generating deepfakes or synthetic media of real people
- Sharing simulation outputs with direct electoral competitors of the same workspace
- Using the API to build derivative products without a separate reseller agreement
5. AI Transparency & Synthetic Content
VoxSim is an AI system; all simulation, poll, and recognition outputs are AI-generated synthetic content, not real opinion polls, surveys, or statements by any real person. In line with Article 50 of the EU AI Act (applicable from 2 August 2026), these outputs are labelled as artificially generated and, where technically feasible, carry a machine-readable marking (a visible and steganographic watermark on PDF reports); the extended deadline for machine-readable marking of pre-existing systems is 2 December 2026. You must not remove these markings or present any output as a genuine opinion poll or as a real statement of any person.
6. Intellectual Property
VoxSim and all underlying technology (population engine, LLM prompts, calibration models) remain the intellectual property of Talivio Technology OÜ. Simulation outputs generated for your workspace are owned by you, subject to the prohibition on misuse above. PDF reports carry a visible and steganographic watermark; removal is prohibited.
7. Limitation of Liability
VoxSim provides probabilistic decision support, not factual predictions of human behaviour. Talivio Technology OÜ disclaims liability for decisions made on the basis of simulation outputs. To the extent permitted by applicable law, neither party is liable for indirect, incidental, or consequential damages, including lost profits. Our maximum aggregate liability to any customer in any 12-month period is limited to the fees that customer paid in that period; for customers on a free or unpaid plan this cap is a fixed EUR 100. This limitation does not apply to liability that cannot be limited or excluded under mandatory law, including liability for intent (wilful misconduct) or gross negligence, for death or personal injury, or under mandatory consumer-protection law.
8. Termination
Either party may terminate the subscription at any time. Upon termination, your workspace data is retained for 30 days before deletion. You may export your simulation reports at any time during an active subscription.
9. Governing Law
The Service is intended for business and professional use. These Terms are governed by the laws of the Republic of Estonia, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). Disputes shall first be escalated to Talivio Technology OÜ in writing; if unresolved within 30 days, they are subject to the exclusive jurisdiction of Harju County Court (Harju Maakohus) in Tallinn, Estonia. Nothing in this clause deprives you of the protection of mandatory provisions of the law of your country of habitual residence or establishment that cannot be derogated from by agreement.
